By creating a BusinessPulse account, starting a free trial, or subscribing to a paid plan, you ("Customer," "you") agree to these Terms of Service ("Terms"). If you do not agree, do not use the service. These Terms constitute a legally binding agreement between you and the operator of BusinessPulse ("we," "us," "our"), a product powered by SnapAPI.
BusinessPulse is an AI-powered competitor intelligence service that:
You must be at least 18 years old (or the age of majority in your jurisdiction) to use BusinessPulse. By creating an account, you represent that the information you provide is accurate and that you have the authority to agree to these Terms.
You are responsible for maintaining the security of your account credentials, including magic link emails and session tokens. Notify us immediately at support@snapapi.tech if you suspect unauthorized access.
14-Day Free Trial. New customers receive a 14-day free trial with access to screenshots and change detection for up to 3 competitor pages. No credit card is required. After 14 days, monitoring stops automatically unless you subscribe to a paid plan. You will NOT be charged at the end of your trial. Free trials are limited to one per person; creating multiple accounts to obtain additional trials is prohibited.
Plans & Pricing. Paid plans (Starter, Pro) are billed monthly through our payment processor, Lemon Squeezy. Current pricing is displayed at snapapi.tech/businesspulse#pricing.
Auto-Renewal. Subscriptions automatically renew each billing cycle until cancelled. You authorize recurring charges to your payment method on file.
Cancellation. You may cancel at any time through the Lemon Squeezy customer portal (linked from your account page). Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing cycle.
Price Changes. We may change pricing with 30 days' notice via email. Continued use after a price change constitutes acceptance.
You agree to use BusinessPulse only for lawful competitive intelligence purposes. You agree NOT to:
Our IP. The BusinessPulse platform, including its code, design, AI models, and branding, is owned by us and protected by intellectual property law.
Third-Party Content. We do not claim ownership of content captured from third-party websites. Screenshots and AI analysis are provided to you as a service for informational purposes. You may not republish or commercially exploit screenshots of third-party websites outside of your internal business use.
Your Data. You retain ownership of the competitor URLs you submit and any account information you provide.
AI-generated analysis is informational only and does not constitute business, legal, or financial advice. AI summaries may contain inaccuracies, misinterpretations, or errors. You should independently verify any AI-generated insights before making business decisions. We are not liable for any actions taken based on AI analysis.

BusinessPulse is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:
To the maximum extent permitted by law, our total liability for any claims arising from your use of BusinessPulse is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from: (a) your use of the service, (b) your violation of these Terms, (c) your monitoring of third-party websites, or (d) any claim by a third party that your use of BusinessPulse infringes their rights.
If you are a website owner and object to your site being monitored by a BusinessPulse customer, contact us at support@snapapi.tech with the URL(s) in question. We will review and may add the URL to our exclusion list.
We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your data will be deleted in accordance with our data retention policy. You may delete your own account at any time through the account dashboard.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you are a consumer in the EU, in which case you retain your right to bring claims in your local courts.
We may update these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use after changes constitutes acceptance.

Account data: Name, email address (provided at signup).
Competitor URLs: The web page URLs you choose to monitor.
Generated data: Screenshots, structural page analysis, AI summaries, and change detection results.
Technical data: IP address (at signup, for abuse prevention), timezone, browser/device information.
Payment data: Processed entirely by Lemon Squeezy. We do NOT store credit card numbers, billing addresses, or bank details.
We do NOT use your data for advertising, profiling, or any purpose unrelated to providing the service.

CCPA: We do not sell personal information. California residents may request disclosure of collected data by emailing support@snapapi.tech.
Your data may be transferred to and processed in the United States (where our infrastructure and third-party processors are located). For EU/EEA users, these transfers are made under Standard Contractual Clauses or equivalent safeguards.
Screenshots may incidentally capture personal data visible on public websites (e.g., employee names, photos). This data is processed under legitimate interest for competitive intelligence purposes. We do not extract or index personal data from screenshots.
BusinessPulse uses only essential cookies/localStorage for session management (login tokens). We do not use tracking cookies, analytics scripts, or advertising pixels.
BusinessPulse is not intended for use by anyone under 18 years of age. We do not knowingly collect data from minors.
We protect your data with encryption in transit (HTTPS), parameterized database queries, HMAC-signed tokens, rate limiting, and access controls. While we take reasonable measures to secure your data, no system is 100% secure.
In the event of a data breach affecting your personal data, we will notify you via email within 72 hours of becoming aware of the breach, as required by GDPR.
We may update this Privacy Policy at any time. Material changes will be communicated via email. The "Last updated" date above reflects the most recent revision.
